HumanConcepts - OrgPlus Privacy Policy Definitions

Agreement

Agreement means the OrgPlus Desktop Software License Agreement that you signed during download or installation of the Software.

Company

Company means HumanConcepts as defined in the Agreement. The term "we" and "our" shall be deemed to refer to the Company.

Privacy Policy

Privacy Policy means this policy as may be amended from time to time.

Software

Service means the Software as defined in the Agreement as may be amended from time to time.

You

You means the Customer as defined in the Agreement. The term "you" and "your" shall be deemed to refer to the Customer.


Scope of Privacy Policy

The Privacy Policy applies to your use of the Company's web pages associated with the Software and the Software. Other Company web pages or other downloaded software may contain their own privacy policies, including terms which differ from this Privacy Policy; however, the applicable privacy policy will posted.


Effective Date

The effective date of this Privacy Policy is June 18, 2005.


Information Collection & Use

Registration

During registration you are required to provide contact information (including but not limited to your electronic mail address and license key).

When you register, we will send you an electronic mail message requesting that you confirm your registration and to confirm the accuracy of the electronic mail address you provided. We also use this information to contact you about the services on our site in which you have expressed interest, to contact you about important changes regarding the Software, for billing purposes, and as further provided below.

Company is the sole owner of the account information collected during registration. Company collects personally identifiable information from our users at several different points during use of our website.

Subsequent Orders

If you purchase further products or services from us (such as software or professional services), we may request certain personally identifiable information from you on our registration and/or order form. You must provide contact information (including but not limited to your name and title, the name of the company, and contact information such as telephone number, mailing address and electronic mail address) and financial information (such as credit card number, expiration date).

We use this information for billing purposes and to fill your orders. In order to confirm your order and if we have trouble processing an order, we will use this information to contact you.

Customer Opinion Surveys

Company is committed to providing you with the best experience possible. From time-to-time we may provide you the opportunity to participate in surveys related to your experience with the Software and/or suggestions for enhancements. If you participate, we will request certain personally identifiable information from you. Participation in these surveys is completely voluntary and you therefore have a choice whether or not to disclose this information. The requested information may include contact information (such as name and electronic mail address), and your individual comments.

We use this information to improve your experience with the Software and to address your suggestions.

We may use a third party service provider to conduct these surveys; that company is prohibited from using our users' personally identifiable information for any other purpose. We will not share the personally identifiable information you provide through a survey with other third parties unless we give you prior notice and choice.

Uses of Information

The information you provide during registration and any update to registration, as well as any subsequent order, will be used to provide you with the product or service you requested.

The Company may collect information in the aggregate, such as general visitor trends and allocation of disk space. This aggregate information does not contain personally identifiable information. The Company will use this information to improve our products and services and ensure our webpages are operating properly.


Communications from the Site

Updates

We may send you information occasionally on additional Company products and services.

Out of respect for your privacy, you have the option not to receive these types of communications. Please see the "Choice and Opt-out."

Service-related Announcements

We will send you service-related announcements when it is necessary to do so. For instance, if an important notice is required to notify you of a defect in the Software or if the license key information indicates the Software is being used in a manner inconsistent with the Agreement, we might send you an email.

You may not opt-out of these communications, which are not promotional in nature.

Customer Service

Based upon the personally identifiable information you provide us, we will send you electronic mail. We will communicate with you in response to your inquiries or to provide the products or services you request. We will communicate with you by email or telephone in regards to your inquiries, in accordance with your wishes.

Profile

We store information that we collect through cookies, log files, clear gifs, and/or third party sources to create a "profile" of your preferences. We tie your personally identifiable information, and your purchasing history, to information in the profile, in order to provide tailored promotions and marketing offers and to improve the content of the site for you.

We do not share your profile with other third parties.

Supplementation of Information

In order to provide the products and services to you or subsequent services or products, we may on occasion supplement the personally identifiable information you submitted to us with information from third party sources. For example, to determine the Customer's credit worthiness and billing information, we may use the Customer's name and/or Dun & Bradstreet D-U-N-S number to request a credit report and other information. Once we determine your credit-worthiness, we destroy this document.


Information Sharing and Disclosure

Aggregate Information (non-personally identifiable)

We may share aggregated information about our user base with our service providers. This information does not identify individual users. Service providers may include billing processors.

We do not link aggregate user data with personally identifiable information, except as otherwise noted in the Privacy Policy.

Personally identifiable information:

Except as provided in this Privacy Policy, we do not share personally identifiable information about you with third parties.

Agents

We use an outside shipping company to fulfill orders, and a credit card processing company to bill you for goods and services. These companies do not retain, share, store or use personally identifiable information for any other purposes.

Service Providers

We use other third parties to provide services on our site. Generally, your personally identifiable information will not be disclosed to any service provider except to provide support or maintenance you request.

Legal Disclaimer

We also reserve the right to disclose your personally identifiable information: (i) with your permission, (ii) when such disclosure is to provide you with a product or service you have requested, subject to confidentiality obligations, (iii) pursuant to a court order, subpoena or other legally mandated process, (iv) to enforce our rights in connection with the Agreement, (v) to the extent the Company in its opinion believes is necessary to investigate or prevent a criminal or tortuous act.


Choice/Opt-out

We provide you the opportunity to 'opt-out' of having your personally identifiable information used for certain purposes, when we ask for this information. For example, if you purchase a product/service but do not wish to receive any additional marketing material from us, you can indicate your preference on our order form.

If you no longer wish to receive our newsletter and promotional communications, you may opt-out of receiving them by following the instructions included in each newsletter or communication or by emailing us at unsubscribe@humanconcepts.com, or you may contact us at 1-415-332-3030 or 3 Harbor Drive, Suite 200, Sausalito, CA 94965 to opt-out.

You will be notified when your personal information is collected by any third party that is not our agent/service provider, so you can make an informed choice as to whether or not to share your information with that party.


Log File

As is true of most Web sites, we gather certain information automatically and store it in log files. This information includes internet protocol (IP) addresses, browser type, internet service provider (ISP), referring/exit pages, operating system, date/time stamp, and clickstream data.

We use this information, which does not identify individual users, to analyze trends, to administer the site, to track users' movements around the site and to gather demographic information about our user base as a whole.

We do link this automatically-collected data to personally identifiable information. For example, IP addresses may be tied to personally identifiable information for security purposes and to improve your experience with our website.

We use a third-party tracking service called HitBox that uses cookies, log files, and clear gifs to track non-personally identifiable information about visitors to our site in the aggregate in order to improve the quality of the visit to our website and to log general trends.


Cookies

A cookie is a small text file that is stored on a user's computer for record-keeping purposes. We use cookies on this site. We link the information we store in cookies to personally identifiable information you submit while on our site.

We use both session ID cookies and/or persistent cookies. We use session cookies to make it easier for you to navigate our site. A session ID cookie expires when you close you browser. A persistent cookie remains on your hard drive for an extended period of time.

We use persistent cookies as part of the Software. We set a persistent cookie to store your language preferences and other preferences, and to log your license key and Software version, so you don't have to enter it more than once. Persistent cookies also enable us to track and target the interests of our users to enhance the experience on our site.

If you reject cookies, you may still use our site, but your ability to use some areas of our site will be limited. For example, the Company uses session cookies as part of its shopping cart, and you may be unable to complete a purchase if you reject cookies. Furthermore, if you reject persistent cookies, the Software may not operate properly.

Some of our business partners (e.g., marketing partners) use cookies on our site. We have no access to or control over these cookies.


Access to Personally Identifiable Information

If your personally identifiable information changes, or if you no longer desire communications, you may update or delete it by contacting us via electronic mail or postal mail at the contact information listed below.


Security

The security of your personal information is important to us. When you enter sensitive information (such as credit card number) on our registration or order forms, we encrypt that information using secure socket layer technology (SSL).

We follow generally accepted industry standards to protect the personally identifiable information submitted to us, both during transmission and once we receive it. Our servers are hosted at a secure hosting facility. The servers are protected by firewalls to protect the data. The servers are protected from physical access using reasonable industry precautions.

However, no method of transmission over the Internet, or method of electronic storage, is 100% secure. Therefore, while we strive to use commercially acceptable means to protect your personally identifiable information, we cannot guarantee its absolute security.

Business Transitions

In the event the Company goes through a business transition, such as a merger, acquisition by another company, sale of all or a portion of its assets, or initial public offering, your personally identifiable information likely will be among the assets transferred. You will be notified via email or your physical mailing address of any such change in ownership or control of your personally identifiable information.


Changes in this Privacy Statement

If we decide to change our privacy policy, we will post those changes to this privacy statement and other places we deem appropriate so that you are aware of what information we collect, how we use it, and under what circumstances, if any, we disclose it.

We reserve the right to modify this privacy statement at any time, so please review it frequently. If we make material changes to this policy, we will notify you here or by email. Any change to our Privacy Policy shall be effective upon posting or upon any notice to you.
